'm jon kelley. san jose police on the scene of a deadly hit and run. that is where bob rydell is. what can you tell us? what's the latest? >> reporter: good morning, jon. we're here at the intersection of allen rock and jackson in san jose. we're waiting for the coroner to arrive to complete their part of the investigation and remove the body, as you can see, it is still in the middle of the road. it appears this person was carrying a backpack of some sort, perhaps trying to cross the street when they were hit and killed. this was a hit and run. police are looking for that driver. the only description they have is the dark colored vehicle heading wet bound on allen rock. we understand at least one witness who flagged down a bus, offer help, was able to identify the car. route 70 by the way is being rerouted. a investigation will focus on the road conditions at the time. it was just after 6:00 this happened so it was still dark out and most likely raining at the time. you can see, it's been raining off and on. so whether weather conditions played a role in the accident will be part of t

:26. good morning, everybody. i'm jon kelley. a student at a san jose elementary school is now suing the principal, the teacher and school district for negligence and sexual abuse. this lawsuit claims the girl was abused by her teacher at o.b. whaley elementary school two years ago and the principal failed to act on those accusations. this lawsuit coming as the criminal trial against the principal is expected to wrap up sometime today. she is facing charges for faelg the report the abuse allegations against craig chandler. she admits in court yesterday she knew about the parents' concerns with chandler but did not report him because he assured her he wasn't doing anything inappropriate. chandler was later arrested and charged with committing lewd acts on five children. this marks the second time in 20 years prosecutors have charged a school administrator for not calling authorities in a situation like this. >>> right now let's check that weekend forecast. christina loren is here to talk about it. a nice one. >> yeah, we've got a great-looking day and weekend coming up. 51 degrees in
